Can I Pay Someone to Donate His Kidney? – Mawlana Ilyas Patel

Question

My Kidneys are not working anymore. If I were to pay a person to give me his kidney, would that be halal? Or we say that he donates his kidney, and we promise him he will get a residence permit in Germany.

I pray you are in good faith and health. Thank you for your question.

There have been differences of opinion on organ donation. Esteemed Muftis are of the opinion that in life-threatening cases, one can buy an organ; however, they do not support the selling of organs. Also, receiving an organ in return for a residence permit will not be permissible.

The summary of a group of Muftis, Jurists, and scholars is as follows:

“It is permissible to transfer whole or part of organs from a deceased to another person if the need for such a transplant is critical. Live organ donation is also allowed if the recipient is in urgent need of the organ.”

Mawlana Ilyas Patel is a traditionally-trained scholar who has studied within UK, India, Pakistan, Syria, Jordan and Turkey.

He started his early education in UK. He went onto complete hifz of Qur’an in India, then enrolled into an Islamic seminary in UK where he studied the secular and Alimiyyah sciences. He then travelled to Karachi, Pakistan.

He has been an Imam in Rep of Ireland for a number of years. He has taught hifz of the Qur’an, Tajwid, Fiqh and many other Islamic sciences to both children and adults onsite and online extensively in UK and Ireland. He was teaching at a local Islamic seminary for 12 years in the UK where he was a librarian and a teacher of Islamic sciences.

He currently resides in UK with his wife. His personal interest is love of books and gardening.
